    Now watch another judge overturn the correct "un-constitutional" ruling of the first judge.
    All you need to do is find another judge to overturn the first one.

  • Nobody seems to have noticed the elephant in the room. The Jobs and Tax bill did two things wrt the ACA:

  • It reduced the penalty for failure to maintain coverage to $0 for the 2018 tax year
  • It repealed the individual mandate effective January 1, 2019

    By the time this Distruct court ruling is reviewed by the 5th Circuit the Individual Mandate and the $0 tax penalty will no longer be a part of the law. The mandate itself, the alleged tax defect, and the severability issue will have been resolved by GOP lead congressional action. I am not a lawyer but that generally renders the complaint moot. Consequently I don't think it will require any exercise in judicial activism to simply dismiss the complaint.

    The upper court could of course decide to consider the opinion set forth by Judge O'Connor that a tax that does not generate revenue can not be fairly read as a tax. That might have bearing as precedent on future legislation that implements a $0 tax penalty. But regardless of how they decided that issue it would not alter the fact that the ACA as currently instantiated is now free of that defect.

    In other words I don't expect an ACA that as of January 1 no longer contains an individual mandate and attendant penalty to be struck down by a higher court. Most especially the US Supreme Court where the 5 justices that have rejected all previous challenges are still sitting.

  • Seems I had that wrong. The full tax is still in effect for 2018 and 2019 is the effective date for the zero rate. So the issue is not moot.

    Wondering just how Nancy plans to "intervene in the appeal process."

  • So Paul hopes the millions of folks he cares so much about will lose their health insurance because he thinks it will give his side a political advantage? Now that shows a big heart. No matter what the cost, it is worth it to get blue votes. Wow!

    Kind of reminds me of LBJ and MacNamera choosing to sacrifice the lives 58,000 Americans and untold numbers of Vietnamese (all under wraps until it got away from them) to maintain a political advantage to get votes for the War on Poverty/Great Society. Gotta love these Dems.

  • That's the way lib/dems think, Jim.

    The ends nearly always justify the means. Right out of Alinsky.

    Currently, just about all lib/dems are praying (sorry, not praying, but probably dancing around the bone fire beneath a full moon) for a recession or depression for which they can blame Trump.

    They are what they are.

    Just like I waited for the 2018 blue wave that did not occur.

    I liked the wave that actually did occur in 2010.
