  • Morning Guys.

    I have some ground, about 35 acres, that is in CRP, but is going to expire in Sept. The farmer that works the ground next to it has expressed an interest in returning it to farm ground. Thee is russian olive in abundance. My question is, is this a hand shake agreement? Is there a standard form for this kind of thing? He has suggested that we could work out a reduction in rent in exchange for clearing the ground, which sounds great to me. What do I need to watch out for? How much control does the renting farmer have, as far as allowing others to access the ground, as in hunting rights? Thanks

  • I remember hearing about a hand shake agreement once.
    I believe it was two guys named Harry and Henry.
    It went good until Henry's grandson got involved.
    Then again, you might not have a grandson to deal with.
    Yet.

  • In case you didn't know Harry Ferguson's real first name was Henry even though people call him by his nickname "Harry" So, Henry and Henry isn't technically wrong!

  • Laws vary in different states. In Iowa you could do it on a hand shake but a legal contract would likely give you more control. Google "Land Rental Agreement Forms" and you will find many forms to work with.

    Your control is in the agreement, written or verbal. I would suggest either be with a trusted witness.

    This is my opinion. I am not a lawyer!

    I never found cash rent as productive as CRP payments but you do have the Russian Olive problem to consider.

  • If CRP needs maintenance, it becomes less lucrative.

    I have a contract on 183 acres expiring in 2022.

    I have an annual grass called Ventenata. It costs me around $20/acre to spray with a premergent herbicide. Not a lot of acres, but. I also have Multiflora Rose, an invasive shrub, also tough to kill. 32 years ago we had some Canada Thistles and Field Bindweed to spray.

    My father put it in CRP about 32 years ago. 3 10 year contracts and a 3 year extension.

    I'm not sure about Russian Olive, but I think with CRP, the income less the maintenance costs makes getting cash rent look better.

  • Contact you're county extension service. They should be able to help you.
    They should also have photos of the land with information about it.
